Xarelto Lawsuits to be Selected for Case-Specific Discovery

In an Order dated May 4, 2015, Judge Eldon E. Fallon of the Eastern District of Louisiana directed that 40 to 60 Xarelto bleeding lawsuits be designated for specific discovery.

Bayer HealthCare and Johnson & Johnson’s subsidiary, Janssen Pharmaceuticals currently face over 400 lawsuits alleging that Xarelto is dangerous and defective. Because of the large number of lawsuits, the Xarelto bleeding lawsuits have been designated as a multi-district litigation (MDL) and consolidated before Judge Fallon. MDLs are intended to reduce administrative demands on the parties, avoid duplicative discovery on common issues, and prevent conflicting pretrial rulings made by different judges.

What is Xarelto?

Xarelto (rivaroxaban) is an anticoagulant, or blood thinner, medication manufactured and marketed by Bayer and Janssen. Blood thinners are commonly prescribed to reduce the risk of blood clots and stroke in patients with atrial fibrillation and deep vein thrombosis following knee or hip replacement surgery.

Xarelto is one of the newest blood thinners prescribed in one uniform dose, as opposed to older anticoagulants such as Coumadin (warfarin) that require doctors to prescribe specific doses for each patient. Warfarin also requires changes in diet and lifestyle and regular checkups, which prompted drug companies to develop more convenient alternatives like Xarelto.

Although the effects of traditional blood thinners can be reversed with vitamin K, there is no such antidote available for Xarelto and in an emergency, there is no means to stop the bleeding once it starts, leading to serious injuries and even death.
